Man arrested after California domestic violence incident

by | Dec 23, 2015 | Domestic Violence, Firm News

It is often difficult to share living space with another person. Even two people who have only positive feelings toward one another can find themselves embroiled in an argument that could quickly and unexpectedly turn to violence. California police officers were recently called to the scene of what they believe was an argument that lead to domestic violence. A man has since been arrested.

Police claim that they were called to the scene one afternoon on a day in late November. A female claims that she and a 24-year-old man, apparently someone she lives with, become embroiled in an argument. She claims that he threw her on the couch and choked her until she almost lost consciousness.

She further asserts that she may have broken a finger and fingernail during the struggle. Police claim that redness around her neck also supports her story. The man has since been arrested and charged with battery of a spouse or cohabitant. If convicted, he could face imprisonment and a fine.

Allegations of domestic violence must be taken seriously. However, as in all cases, there must be sufficient evidence in order to gain a conviction. The injuries the California woman suffered could have occurred in a variety of different ways. Other than her word, it is unclear if there is any other evidence that definitively links the man to the crimes of which he is accused. An experienced attorney may be able to better prepare a criminal defense for the defendant, including advising him of his legal options in regards to the charges he faces.
